1. Agreement to These Terms

These Terms of Service govern your access to and use of DripLynx, including the website, application, campaign tools, contact management features, automation tools, billing features, and any related services.

By creating an account, logging in, scheduling a demo, importing contacts, creating campaigns, purchasing credits, or using the platform, you agree to these Terms. If you do not agree, you should not use DripLynx.

2. Description of the Platform

DripLynx is a plug-and-play outreach automation platform designed to help users manage campaign workflows across RVM, SMS, postcards, email, and related automations.

DripLynx is not intended to replace your CRM. It is designed to work alongside CRMs, spreadsheets, databases, dialers, phone systems, and other business tools through imports, integrations, webhooks, APIs, and custom workflows.

Platform features may include contact management, campaign membership, scheduling, callback routing, delivery jobs, notifications, suppression controls, credit balances, billing settings, and usage tracking.

3. Accounts and User Responsibilities

You are responsible for maintaining accurate account information, including your name, business information, email address, verified callback numbers, billing information, and any other information required to operate the platform.

You are responsible for all activity under your account. You should keep your login credentials secure and notify us if you believe your account has been accessed without authorization.

You may not create an account using false information, impersonate another person or business, or use DripLynx for a business or campaign you are not authorized to operate.

4. Campaigns, Contacts, and Automation Activity

You are responsible for the contacts you upload, import, create, edit, select, suppress, or add to campaigns. You are also responsible for the campaign content you create, including voicemail audio, SMS copy, email copy, postcard content, URLs, notes, and any other campaign material.

DripLynx provides campaign controls, but you decide who receives outreach, which campaign is sent, when it is sent, what message is used, and which contact data is used for targeting or automation.

Contacts are intended to receive campaigns only after being intentionally added to a campaign or automation workflow. You should review your campaign membership, suppressions, consent fields, schedules, and content before activating or sending campaigns.

5. Compliance Responsibilities

You are solely responsible for ensuring that your use of DripLynx complies with all laws, rules, regulations, provider policies, carrier rules, platform rules, and industry requirements that apply to your campaigns.

This may include rules related to calls, ringless voicemail, SMS, email, postcards, direct marketing, consent, opt-outs, do-not-call lists, do-not-contact requests, privacy, data retention, advertising, and consumer protection.

DripLynx may provide tools such as consent fields, suppression controls, contact history, campaign membership, and delivery records, but those tools do not guarantee legal compliance. You remain responsible for how you use them.

You should consult your own legal counsel before running campaigns, especially campaigns involving regulated industries, consumers, healthcare, financial services, insurance, political messaging, lead generation, or high-volume outreach.

6. Acceptable Use

You may not use DripLynx to:

• Send unlawful, fraudulent, deceptive, abusive, harassing, threatening, or misleading messages.
• Contact people without proper authorization, consent, or legal basis where required.
• Ignore opt-outs, suppressions, do-not-call requests, unsubscribe requests, or similar requests.
• Upload stolen, purchased, scraped, or unauthorized contact lists where use is not permitted.
• Impersonate another business, person, agency, carrier, provider, or government entity.
• Send spam, phishing, malware, scams, fake offers, or deceptive lead-generation campaigns.
• Interfere with, overload, reverse engineer, scrape, attack, or abuse the platform.
• Use the platform in a way that causes provider, carrier, payment processor, or infrastructure issues.

We may suspend or terminate access if we believe your use of the platform creates legal, technical, reputational, deliverability, billing, security, or provider risk.

7. Billing, Credits, and Subscriptions

DripLynx may offer subscriptions, usage credits, pay-as-you-go credit packs, monthly plans, implementation services, custom integrations, or other paid services.

By purchasing a subscription, credits, or services, you authorize the applicable charges using your selected payment method. Pricing, included credits, usage rates, plan limits, and available features may change over time.

Credits may be used for campaign activity and related platform usage. Unless stated otherwise in writing, credits have no cash value, are not a bank account, are not transferable, and may not be redeemed for cash.

Failed, blocked, rejected, cancelled, or provider-limited delivery attempts may still create costs depending on the provider, channel, and campaign workflow.

8. Third-Party Providers and Integrations

DripLynx may rely on third-party providers for voice, SMS, email, postcard printing, payment processing, hosting, analytics, CRM integrations, identity, storage, or other services.

Third-party providers may have their own rules, prices, limits, policies, outages, review processes, delivery restrictions, compliance requirements, and account requirements.

We are not responsible for delays, failures, filtering, carrier blocking, provider rejection, provider downtime, third-party policy changes, CRM API changes, payment processor decisions, or delivery results outside our direct control.

9. Data, Content, and Permissions

You retain responsibility for the contact data, campaign content, files, audio, messages, notes, and other materials you upload or create in DripLynx.

You grant DripLynx permission to process your data as needed to provide the platform, operate campaigns, manage contacts, show records, perform integrations, process billing, troubleshoot issues, and improve the service.

You represent that you have the necessary rights, permissions, consents, and legal basis to upload, store, process, and use the data and campaign content you provide.

10. Suspension and Termination

You may stop using DripLynx at any time. We may suspend or terminate your access if you violate these Terms, create risk for the platform, fail to pay amounts owed, misuse the service, violate provider requirements, or use the platform in a harmful or unlawful way.

After termination, we may retain certain information as needed for legal, billing, audit, dispute, fraud prevention, security, backup, or operational purposes.

11. Disclaimers and Limitation of Liability

DripLynx is provided on an “as is” and “as available” basis. We do not guarantee uninterrupted operation, perfect deliverability, campaign results, revenue increases, legal compliance, provider approval, carrier acceptance, or error-free performance.

To the maximum extent allowed by law, DripLynx will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, including lost profits, lost revenue, lost data, lost goodwill, campaign losses, delivery failures, or business interruption.

Nothing in these Terms limits liability where the law does not allow that limitation.

12. Changes to These Terms

We may update these Terms from time to time. Updated Terms may be posted on this page with a revised effective date. Continued use of DripLynx after changes are posted means you accept the updated Terms.
